The project was supposed to be a 55-storey building, with the 14th floor being the designated floor for Rode’s flat. The development work came to a halt in 2016, and no progress has been made since then. Rode filed a complaint with the Mumbai police and subsequently lodged a First Information Report (FIR) against Atithi Patel, the property developer involved in the project at the time. According to Rode’s complaint, he had been promised that the building would be completed by December 2018. In order to secure the flat, Rode made an initial payment of Rs 1.5 lakh and subsequently paid monthly instalments of Rs 5 lakh between May 2016 and May 2017, totalling Rs 2.11 crore. However, Rode encountered issues when he requested the allotment letters and the registration of the flat, as Patel failed to provide them. It was at this point that Rode discovered that no progress had been made beyond the 14th floor of the building. He demanded a refund of his money, but Patel refused to return it. According to Patel’s representative, builders do not typically refund money after cancellation, but they advised Rode to wait and have faith. The representative did not provide any information regarding the status of the construction site in Goregaon. Additionally, the representative mentioned in an email that Rode was causing delays in registering the flat.
